INSIGHTS is intended to support evidence-based decision making. It does not replace professional judgement, infection prevention policies or manufacturer operating instructions.
2. Eligibility
To use INSIGHTS you must:

INSIGHTS records and presents information entered by authorised users but cannot verify that individual validation activities have been performed correctly.
6. Validation Results
INSIGHTS records, analyses and reports validation information provided by authorised users.
Validation Reports, Comparison Reports and Monthly Insights are intended to support operational decision making and quality assurance.
INSIGHTS does not certify the safety, effectiveness or regulatory compliance of any UV disinfection device, room, process or facility.
The responsibility for interpreting validation results and determining appropriate corrective actions remains with the customer organisation.
7. DoseDots and Validation Media
Where INSIGHTS is used with DoseDots or other supported validation media, users are responsible for ensuring they are used in accordance with the applicable instructions.
Unique identifiers, including QR codes, are used to associate physical validation media with digital validation records.
Users must not intentionally duplicate, alter or misuse validation identifiers.
8. Customer Data
All validation records, uploaded photographs, reports, templates and operational data entered into INSIGHTS remain the property of the customer organisation.
EM Consulting does not claim ownership of customer data.
Customer data is processed solely for the purpose of providing the INSIGHTS service and in accordance with our Privacy Policy and any applicable Data Processing Agreement.
9. Intellectual Property
The INSIGHTS platform, software, website, branding, graphics, documentation and associated intellectual property are owned by or licensed to EM Consulting.
Nothing in these Terms transfers ownership of the INSIGHTS platform or associated intellectual property to users.
Customers retain ownership of the data they create within the platform.
10. Scientific Integrity
INSIGHTS has been developed to support objective, evidence-based validation of UV disinfection systems.
Validation data is presented as recorded and is not modified to favour any manufacturer, technology or commercial interest.
Reports are generated from recorded validation data and configured validation parameters. INSIGHTS does not alter validation outcomes to influence purchasing decisions, product comparisons or performance assessments.
11. Availability of Service
EM Consulting aims to provide a reliable and secure platform.
However, uninterrupted availability cannot be guaranteed.
The platform may occasionally be unavailable due to:

Validation Support
INSIGHTS is a decision-support platform designed to record, organise and present validation information. It does not perform UV disinfection, measure UV energy independently, control UV devices or certify the effectiveness of any disinfection process.
Validation Reports, Comparison Reports and Monthly Insights are generated from information recorded within the platform and should be interpreted as supporting documentation rather than certification of disinfection performance.
Customer Responsibility
The customer organisation remains solely responsible for:

selecting appropriate UV disinfection equipment;

establishing validation procedures;
-
correctly placing validation media;
-
carrying out validation activities;
-
interpreting validation results;
-
determining whether corrective actions are required;
-
complying with applicable regulations, standards and internal policies.
Use of INSIGHTS does not transfer these responsibilities to EM Consulting.
Accuracy of Customer Data
INSIGHTS relies on information entered or uploaded by authorised users.
EM Consulting cannot verify the accuracy, completeness or correctness of customer-supplied information and accepts no responsibility for conclusions or decisions based upon inaccurate, incomplete or misleading data entered by users.
No Performance Guarantee
A successful validation recorded within INSIGHTS does not constitute a guarantee that:

a room has been effectively disinfected;
-
a particular UV dose has been delivered to every surface;
-
microorganisms have been eliminated;
-
infection transmission has been prevented;
-
regulatory compliance has been achieved.
Validation results should always be interpreted alongside the customer's own procedures, risk assessments and recognised best practice.
Independent Platform
INSIGHTS has been developed as an independent validation platform.
Validation data is presented as recorded and is not modified, enhanced or suppressed to favour any manufacturer, UV technology, product or commercial interest.
Reports reflect recorded validation information and configured validation parameters only.
No Clinical or Regulatory Advice
INSIGHTS does not provide medical, clinical, infection prevention, engineering or regulatory advice.
Nothing within the platform should be interpreted as replacing the professional judgement of infection prevention specialists, clinicians, healthcare professionals, engineers or regulatory authorities.
Service Availability
Although EM Consulting aims to provide a reliable service, uninterrupted access cannot be guaranteed.
Temporary interruptions may occur due to maintenance, software updates, technical issues or circumstances beyond our reasonable control.
Customers should maintain appropriate operational procedures and should not rely solely on the availability of INSIGHTS where uninterrupted access is essential.
16. Limitation of Liability
To the fullest extent permitted by applicable law, EM Consulting shall not be liable for any indirect, incidental, consequential, exemplary or special damages arising from or relating to the use of INSIGHTS.
This includes, but is not limited to:

loss of business opportunities;

business interruption;

loss of goodwill;

reputational damage;

loss or corruption of data;

costs arising from equipment downtime;

claims made by third parties.
Except where liability cannot legally be excluded or limited, EM Consulting's total aggregate liability arising from or relating to the use of INSIGHTS shall not exceed the total fees paid by the customer for access to the INSIGHTS platform during the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot be excluded under applicable law.
17. Changes to These Terms
EM Consulting may update these Terms from time to time to reflect changes in legislation, technology or the INSIGHTS platform.
The latest version will always be published on the INSIGHTS website together with the effective date.
Continued use of the platform after changes have been published constitutes acceptance of the updated Terms.
